Denver Child Custody Attorney: Areas of Practice

Do you need legal representation in a child custody case?

Child custody battles are often extremely emotional as, in most cases, they involve the children from a couple who has decided to either seek a legal separation or file for a dissolution of marriage. In order to clarify the responsibilities which go along with child custody, the state of Colorado has changed the term child custody to the allocation of decision-making and residential responsibility.

The first part of child custody cases in Colorado is the decision-making part. This is where the parents must decide whether or not they will be able to continue to work together in order to make decisions for the best interests of their children. If they are unable to jointly and amenably make decisions with their children's best interests in mind, then the court may divide decision-making responsibilities between the parents. One parent may be better equipped to make the decisions regarding major medical and religious issues, while the other parent may be better at making educational and extra-curricular activity decisions.

The second part of child custody cases is the residential responsibility part. The means where will the children reside most of the time. If the children will be living with both parents for an equal amount of time, the parents share residential responsibility. If one parent has the children for the majority of the time, that parent is considered to have residential responsibility.

As the court ultimately decides how the decision-making and residential responsibility roles will be allocated between parents, it is important that you have a Denver divorce lawyer from our firm to represent you and your interests. Our attorneys will be able to review your situation, advise you of your best legal options, help prepare you for court, and fight aggressively to protect your parental rights.
